Do I need a Model release form?
Understanding the Model release form is essential for people wanting to get into modelling as a career here is the information you will need to know.
A model release form is required by all models when images are created. It is a contract between a model and a photographer detailing rights over images held by both parties.
A model release should be received from a photographer directly or should be sorted out by an agency, who will have a standard model release form. If you are working through an agency then they will often deal with the photographer and client for you. If like many people you don't have an agent it is essential that you research Model Release forms to find standard templates which set out how, where, and for what your pictures will be used. If you are new to the industry you may be naive about these facts and if, for example, you become very successful in the future someone may be able to make huge amounts of money from you without you getting a penny if you have not studied your model release form.
Put simply, a model release form is a contract which states that you, the model agree to the photographer taking photos of you and subsequently using these photos. Copyright is always retained by the photographer and you sign an agreement to allow them to use the images. This generally means that they will not have to contact you in future to use the photos or make further payments to you. It is possible to create new contracts at a later date, or amend old model release forms but this depends on whether you are dealing with good photographers and agencies.
It is important that as you build up a reputation you understand that the model release form is where you are able to negotiate with photographers and clients to secure a good deal for yourself when handing over the rights. You can be very specific about exactly where the photos will be used and by who and it is important to be pay great attention to this. The model release form is also the contract which sets out how much you are going to get paid for the work, so it is a good idea to have an idea of what realistic figure you are expecting.
Remember that photographers like to work with models who they get on and work well with, so try to maintain good working relationships. This means acting professionally as a newcomer to the industry as this will be looked upon favourably and will mean that you build mutually beneficial relationships with clients. The more experience and contacts you gain the more you can think about bargaining over detail.
If you are with a good agency they will take care of most business dealings, discussing terms for the model release form, and as a minor you will need a chaperone or parent to be present for you to sign the model release form.
